British Culture Archive (“BCA”) documents, preserves and represents photography that reflects the social and cultural landscape of Britain. These Terms & Conditions set out the rules governing the use of our website, the licensing of images, the purchase of prints and publications, the People’s Archive submissions, and the participation of photographers in our representation programme.

By accessing or using this website, you agree to these Terms & Conditions.


1. Introduction

The British Culture Archive website is operated by The People’s Archive Limited, the legal trading entity behind British Culture Archive. By using this website or engaging with BCA for licensing, representation or print purchases, you acknowledge that:

• All content is provided for information and research purposes only
• No rights or licences are granted without written permission
• These Terms & Conditions may be updated periodically

If you do not agree with these terms, please refrain from using the site.


2. Copyright & Ownership

All photographs, text, design elements and digital assets on this website are protected by UK and international copyright law.

• Copyright remains solely with the photographers or their estates
• BCA acts as the authorised representative for certain photographers
• No image may be reproduced, downloaded, copied or used without written permission from BCA
• No rights are transferred by browsing or viewing images on the site

Any unauthorised use constitutes copyright infringement.


3. Prohibited Use

To protect the rights of represented photographers, the following uses are strictly prohibited:

• The use of BCA images for AI training, machine learning or data-mining technologies
• Downloading, copying or extracting images from BCA platforms without an approved licence
• Reusing, redistributing, adapting or repurposing images in any form, including commercial, editorial, promotional, social media or derivative artworks
• Unauthorised reproduction for merchandise, resale, print-on-demand services or third-party platforms
• Scraping, harvesting or automated collection of images or metadata from the BCA website

BCA reserves the right to pursue legal action for any breach.


4. Licensing & Image Use

BCA licenses images for editorial, commercial, cultural, educational and broadcast use.

General Licensing Terms
• A licence is only granted upon written confirmation from BCA
• Licences are non-transferable and may not be sub-licensed unless agreed in writing
• Any usage outside the agreed terms requires a new licence
• All licence fees must be paid in advance of publication or broadcast
• Credit must be given to the photographer and to British Culture Archive

No Implied Licence
Viewing or accessing images does not grant any right of use.

Client Responsibility
Clients must ensure compliance with all usage terms and clear any additional third-party rights where required.


5. Photographer Representation

BCA represents a curated selection of photographers for licensing, rights management and commercial opportunities.

• Representation is by invitation or submission only
• Submissions are reviewed once per year
• Acceptance is not guaranteed
• Photographers retain all copyright
• Representation agreements are governed separately under BCA’s membership tiers


6. Print & Book Sales

Fulfilment & Delivery
• All print orders are produced by professional print partners
• Production and delivery times may vary
• International orders may incur customs duties and taxes, payable by the customer

Returns & Refunds
• Prints are made to order and cannot be returned unless damaged or defective
• Books may be returned only if unopened or faulty
• Any issues must be reported within 7 days of receipt

Loss or Damage
BCA is not responsible for delays, loss or damage caused by couriers, postal services or customs processes.


7. Website Use

Users agree not to:

• Interfere with the security or integrity of the website
• Attempt to bypass technical protection measures
• Disrupt website function or accessibility
• Upload harmful code or perform automated scraping

BCA may restrict access for violations.


8. Liability

To the fullest extent permitted by law:

• BCA is not liable for indirect, incidental or consequential damages
• BCA is not responsible for losses arising from unauthorised third-party use of images
• All content is provided “as is” without warranties of accuracy or completeness

Nothing in these terms limits liability where unlawful under UK law.


9. Privacy & Data

Any personal data collected by BCA is processed in accordance with our Privacy Policy. BCA does not sell or share personal data except where required for order fulfilment or legal obligations.


10. Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12. People’s Archive Submissions

The People’s Archive is a public, crowdsourced project that celebrates everyday photography documenting life across Britain. By submitting photographs, captions, stories or related materials (“Submissions”), you agree that:

• You are the creator of the material or have permission to submit it
• You grant BCA a non-exclusive, worldwide licence to use the Submission in BCA projects
• Permitted uses include editorial articles, online features, exhibitions, books, publications and promotional materials connected to BCA’s mission
• You retain full copyright
• BCA will never commercially license your Submission without your explicit written permission
• Contributors will be credited wherever reasonably possible

This licence supports the preservation and public presentation of Britain’s cultural and social history.
