British Culture Archive (“BCA”) is a trading name of The People’s Archive Limited. These Terms & Conditions govern use of the BCA website, purchases from the BCA shop, image licensing and submissions to The People’s Archive.
Photographer representation is governed by a separate written agreement between BCA and the relevant photographer or estate.
By using this website, placing an order, obtaining an image licence or making a submission, you agree to the sections of these terms that apply to you.

Unless stated otherwise, all photographs, writing, graphics, branding, design elements and other content displayed on this website are owned by, or licensed to, BCA and are protected by copyright and other intellectual property laws.
Copyright in photographs normally remains with the photographer or their estate. BCA acts as the authorised representative for selected photographers, estates and bodies of work.
Viewing a photograph or other material on this website does not grant any licence or right to reproduce, publish, distribute or otherwise use it.
You may share links to publicly available BCA pages. You may not reproduce or distribute the photographs or other protected content displayed on those pages without prior written permission.

BCA licenses selected images on behalf of photographers and estates for editorial, publishing, commercial, cultural, educational, exhibition and broadcast use.

A licence is granted only when BCA has confirmed the agreed use in writing. The licence confirmation, quotation, invoice or separate licensing agreement will specify the relevant image, use, media, placement, territory, duration and any other restrictions.
Unless agreed otherwise in writing:
Accessing, viewing or receiving a preview image does not create an implied licence.
Where a specific written licence conflicts with this page, the terms of that licence take precedence.
Product descriptions, prices and availability are displayed on the relevant product pages. Prices are shown in pounds sterling unless stated otherwise.
Delivery destinations, available services and delivery charges are shown during checkout.
When you place an order, you will receive an email acknowledging it. All orders remain subject to acceptance and availability. If BCA cannot accept or fulfil an order, you will be informed and any payment received will be refunded.
BCA takes reasonable care to ensure that product descriptions, dimensions and prices are accurate. Photographs of products are illustrative, and colour or appearance may vary slightly according to screen settings, materials and production processes.
Payment is handled through the payment methods displayed at checkout. Payment information may be processed by external payment providers under their own privacy and security terms.
Photographic prints offered through the BCA website are sold on behalf of the photographer or estate identified on the relevant product page.
BCA acts as an authorised agent, managing marketing, payment, order processing, production, fulfilment and customer service in return for a commission.
Books and publications produced or published by British Culture Archive are sold by The People’s Archive Limited.
Selected publications produced by other publishers may also be offered through the BCA shop. Any materially different sales arrangement will be stated on the relevant product page.
For all shop orders, BCA remains the customer’s principal point of contact for payment, delivery, returns and customer service.
Prints may be produced to order by professional print laboratories and fulfilment partners. Estimated production and delivery times are provided on the relevant product page or during checkout.
Delivery dates are estimates unless BCA has expressly agreed a guaranteed date.
Available international destinations may change. Customers ordering outside the United Kingdom are responsible for any import duties, local taxes or customs charges applied by the destination country.
Risk in physical goods passes to the customer when the order is delivered to the customer or another person identified by them. If an order is lost or damaged in transit, contact BCA so that the matter can be investigated and resolved.
Nothing in this section affects your statutory rights.
Cancellations, returns and refunds are governed by the BCA Shipping & Returns policy and applicable consumer law.
Where a statutory right to cancel applies, customers may normally notify BCA within 14 days of receiving their order and then return it within the period stated in the Shipping & Returns policy.
Any exception applying to personalised or genuinely custom-made goods will be clearly stated before purchase. The fact that a standard product is produced after ordering does not, by itself, remove any statutory cancellation right.

Faulty, damaged or incorrectly supplied goods will be handled in accordance with applicable consumer law. Nothing in these terms limits or excludes your statutory rights.

BCA represents a curated selection of photographers and estates for print sales, licensing, exhibitions and, where agreed, publishing.
Representation:
The separate representation agreement determines the scope, exclusivity, revenue arrangements, reporting, duration and termination provisions applying to each relationship.
Where these website terms conflict with a signed representation agreement, the signed agreement takes precedence.

The People’s Archive publishes photographs, captions and personal accounts documenting everyday life across Britain.
By submitting photographs, captions, stories or related material (“Submissions”), you confirm that:
You retain copyright in your Submission.
You grant The People’s Archive Limited a non-exclusive, worldwide, royalty-free licence to store, reproduce, resize, crop where reasonably necessary, publish, display and promote the Submission in connection with BCA and The People’s Archive.
This may include use on BCA websites, editorial features, newsletters, social-media channels, exhibitions, educational projects, books, publications and promotional material connected with BCA’s work.
BCA will not commercially license a Submission to a third party, sell it as a photographic print or use it on merchandise without obtaining separate written permission from the relevant rightsholder.
Submission does not guarantee publication. BCA may decline, edit, caption, withdraw or remove material at its editorial discretion. Contributors will be credited wherever reasonably possible.
Requests concerning future use or removal should be sent to contact@britishculturearchive.co.uk. Removal may not be possible where material has already been printed, distributed, archived or included in an existing contractual commitment.

These terms are governed by the laws of England and Wales.
If you are a consumer, you retain any mandatory rights available under the law of the country in which you live. Consumers resident in another part of the United Kingdom may bring proceedings in their local courts where applicable.
Business disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
